Welcome to GIMETRY. By accessing or using our mobile application, website, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and GIMETRY ("GIMETRY," "we," "us," or "our"), operated from Zürich, Switzerland, currently in the process of formal company registration. Please read them carefully.

2. Description of Service

GIMETRY is a health and wellness application that helps users track their meals and symptoms to surface patterns worth discussing with a healthcare provider. Our Service includes:

• Food and meal logging with ingredient tracking
• Symptom logging and severity tracking
• AI-powered analysis to identify potential food-symptom correlations
• Personalized recommendations and insights
• Data export and reporting features

4.1 Account Creation

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4.2 Age Requirements

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you meet this age requirement.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may terminate your account at any time through your account settings or by contacting us.

5. User Responsibilities and Conduct

You agree to use the Service only for lawful purposes. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Impersonate or attempt to impersonate GIMETRY, our employees, or other users
• Engage in any activity that interferes with or disrupts the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Upload or transmit viruses, malware, or other malicious code
• Collect or harvest personal information of other users
• Use the Service for any commercial purpose without our written consent
• Reverse engineer, decompile, or disassemble any part of the Service

6. Purchases and Payment Terms

6.1 Payments

• All purchases are one-time payments — there are no recurring charges
• Payments are processed securely through Stripe
• Prices are displayed in your local currency via Stripe Adaptive Pricing
• You authorize us to charge your selected payment method for the purchase amount

6.2 Refunds and Withdrawal

Within 14 days of purchase, consumers in the European Union may exercise their statutory right of withdrawal under EU Directive 2011/83/EU. Outside of this statutory period, purchases are generally non-refundable because access begins immediately upon purchase. We evaluate refund requests on a case-by-case basis for legitimate reasons, such as technical issues that prevented use of the Service or unauthorized purchases.

7. Intellectual Property Rights

7.1 Our Content

The Service and its original content, features, and functionality are owned by GIMETRY and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit to the Service (meal logs, symptom reports, photos, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and improving the Service.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with applicable data protection laws, including the GDPR and the Swiss FADP. You have rights regarding your personal data as described in our Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Medical Warranty

WE DO NOT WARRANT THAT THE SERVICE WILL ACCURATELY IDENTIFY FOOD INTOLERANCES OR THAT THE INFORMATION PROVIDED IS COMPLETE, ACCURATE, OR RELIABLE. THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIMETRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless GIMETRY and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms, your use or misuse of the Service, or your violation of any rights of another party.

11. Dispute Resolution

If you have a dispute with us, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceedings. Disputes that cannot be resolved informally are decided by the ordinary courts of Zürich, Switzerland, without prejudice to any mandatory consumer-protection right you have to bring proceedings in the courts of your own country of residence under EU or Swiss law.

12. Governing Law

These Terms are governed by the laws of Switzerland, without regard to its conflict of law provisions. If you are a consumer resident in the EU or EEA, the mandatory consumer-protection laws of your country of residence also apply and take precedence where they conflict with this clause.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data (subject to legal retention requirements)
• You remain liable for any outstanding fees or obligations
• Provisions that by their nature should survive termination will survive

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last Updated" date, sending you an email notification, and displaying an in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and GIMETRY regarding the Service and supersede all prior agreements and understandings.
